1. Purpose
These terms govern the subscription to the Formation Prevention platform and its use. The platform offers cybersecurity awareness modules, accessible online, and a dashboard allowing the client company to follow the training of its employees.
The service is provided by the publisher presented in the legal notice (hereinafter "we"), to companies (hereinafter "the client"). By creating an account, the client accepts these terms.
2. Account and access
The client creates its company's account and designates its administrator. The administrator creates the accounts of the employees and remains responsible for the accuracy of the information entered (names, email addresses) and for managing access within the company.
The administrator can correct the name or email address of an employee account during the 7 days following its creation. They can delete an employee account at any time; however, a deleted account continues to count towards the client's number of employee accounts for 90 days after its deletion.
Login credentials are personal and confidential. The client informs us without delay of any unauthorised use of an account.
3. Price
The price is set per employee account and per year, in accordance with the rates published on the website at the time of the order. Prices are stated in Swiss francs. The price tier of an order depends on the total number of employee accounts purchased by the client, including those of that order; each order then keeps this price, including when it is renewed.
An administrator who activates access to the modules for themselves is counted as an employee.
4. Term, invoicing and payment
- The subscription is concluded for a term of 12 months from its activation.
- It is automatically renewed for 12 months. The client may terminate it at any time from their administrator space, with effect at the end of the current period; for our part, we may terminate it at least 30 days before its expiry.
- The subscription is paid annually, in advance, by card at the time of the order, via our payment provider Stripe.
- Employee accounts can be added at any time. Each addition is a separate order, paid for 12 months at the time of the order and renewed on its own anniversary date, under the same conditions.
- The number of accounts in an order cannot be reduced during the period, and amounts already paid are not refunded, even in the event of termination: the accounts remain usable until the end of the paid period.
- In the event of late payment, we may suspend access to the platform after a reminder that has gone unheeded.
5. Use of the platform
The client and its employees use the platform in accordance with its purpose: the internal training of the company. It is prohibited to resell access, to copy or distribute the content outside the company, and to attempt to circumvent the security measures of the service.
6. Availability and changes
We do everything we can to keep the platform permanently accessible, without being able to guarantee it: interruptions may occur, in particular for maintenance. Content and features evolve; a change does not deprive the client of an essential element of the service during the period already paid for.
7. Data protection
For the data of its employees, the client is the controller and we act as processor, solely to provide the service and according to its instructions. The client informs its employees of the use of the platform. Details of the processing are set out in the privacy policy. At the end of the subscription, the client's data is deleted, unless there is a legal obligation to retain it.
8. Intellectual property
The modules, simulations, texts and illustrations remain our property. The subscription gives the client a personal, non-exclusive and non-transferable right of use, limited to the term of the subscription.
9. Liability
The platform is an awareness tool: it reduces the risk of human error but does not guarantee that no attack will succeed. It does not replace the client's technical and organisational security measures. To the extent permitted by law, our liability is limited to the amount paid by the client for the last 12 months of subscription.
10. Changes to the terms
We may change these terms. The client is informed by email at least 30 days before they come into force; if the client does not accept them, it may terminate the subscription as of that date.
11. Applicable law and jurisdiction
These terms are governed by Swiss law. Any dispute falls within the jurisdiction of the competent courts at the publisher's registered office (Grand Rue 8, 1196 Gland).
